What Determines Fault in an Intersection Crash in Douglas, GA?
Fault in an intersection crash in Douglas or anywhere across Georgia is typically determined by reviewing traffic signals, right-of-way rules, and witness accounts from the scene.
Georgia follows a modified comparative negligence rule, in which a driver can recover damages only if they are found less than 50% at fault for what happened. If a driver is found to share equal or greater responsibility, they may be barred from recovering anything at all. This makes early evidence collection, such as signal timing and witness statements, especially important in cases where fault isn't immediately clear.
People involved in intersection wrecks commonly deal with whiplash, bruising, or more serious trauma if the impact pushes a vehicle off the roadway entirely. Property damage claims can also become complicated when a vehicle ends up somewhere unexpected, like a sidewalk, since additional parties may need to be looped into the claims process.
A Douglas personal injury lawyer can help sort through conflicting accounts of who had the right-of-way, especially when signal timing or visibility played a role. Compensation may be available depending on how liability is ultimately assigned between the drivers.
